En R\u00e9publique d\u00e9mocratique du Congo, la contestation autour de la loi r\u00e9f\u00e9rendaire prend une nouvelle dimension. Soixante-cinq organisations de la soci\u00e9t\u00e9 civile ont demand\u00e9 au pr\u00e9sident F\u00e9lix Tshisekedi de ne pas promulguer le texte adopt\u00e9 par le Parlement et de renoncer \u00e0 tout projet de r\u00e9f\u00e9rendum dans le contexte actuel.<\/p>\n

Leur m\u00e9morandum, pr\u00e9sent\u00e9 lundi 10 ao\u00fbt 2026 \u00e0 Kinshasa, intervient alors que la loi a d\u00e9j\u00e0 re\u00e7u le feu vert de la Cour constitutionnelle. Les signataires estiment toutefois que les priorit\u00e9s du pays sont ailleurs, en particulier dans l\u2019Est, o\u00f9 l\u2019ins\u00e9curit\u00e9 continue de provoquer des d\u00e9placements de populations et une grave crise humanitaire.<\/p>\n

Soixante-cinq organisations interpellent F\u00e9lix Tshisekedi<\/h2>\n

Le document a \u00e9t\u00e9 port\u00e9 par des mouvements et plateformes comme la Dynamique \u00ab Non au changement de la Constitution \u00bb, Civil Bridge, G\u00e9n\u00e9ration Z RDC, la LUCHA-RDC et Filimbi. Selon Radio Okapi et 7sur7, ces organisations demandent au chef de l\u2019\u00c9tat de surseoir \u00e0 la promulgation de la loi r\u00e9f\u00e9rendaire.<\/p>\n

Elles souhaitent aussi l\u2019ouverture d\u2019un dialogue national inclusif. Pour les signataires, une consultation populaire ne devrait pas \u00eatre engag\u00e9e alors que le pays fait face \u00e0 la guerre dans l\u2019Est, \u00e0 une crise socio\u00e9conomique persistante et \u00e0 des besoins humanitaires consid\u00e9rables.<\/p>\n

Cette mobilisation prolonge le bras de fer d\u00e9j\u00e0 engag\u00e9 autour du r\u00e9f\u00e9rendum en RDC<\/a>. En juin, plusieurs acteurs politiques et citoyens avaient exprim\u00e9 leur crainte de voir ce m\u00e9canisme utilis\u00e9 pour toucher aux r\u00e8gles du pouvoir.<\/p>\n

La loi a d\u00e9j\u00e0 franchi l\u2019\u00e9tape de la Cour constitutionnelle<\/h2>\n

La loi r\u00e9f\u00e9rendaire a \u00e9t\u00e9 adopt\u00e9e par le Parlement avant d\u2019\u00eatre examin\u00e9e par la Cour constitutionnelle. Le 28 juillet, les juges l\u2019ont d\u00e9clar\u00e9e conforme \u00e0 la Constitution, tout en formulant des r\u00e9serves d\u2019interpr\u00e9tation sur certaines dispositions consid\u00e9r\u00e9es comme fondamentales.<\/p>\n

Le texte doit maintenant \u00eatre promulgu\u00e9 par le pr\u00e9sident de la R\u00e9publique pour entrer en vigueur. C\u2019est pr\u00e9cis\u00e9ment cette \u00e9tape que les organisations de la soci\u00e9t\u00e9 civile veulent suspendre.<\/p>\n

Du c\u00f4t\u00e9 du pouvoir, l\u2019Union pour la d\u00e9mocratie et le progr\u00e8s social affirme que cette loi vient combler un vide juridique. Ses d\u00e9fenseurs rappellent qu\u2019un r\u00e9f\u00e9rendum est pr\u00e9vu par les institutions congolaises et qu\u2019il doit disposer d\u2019un cadre l\u00e9gal clair.<\/p>\n

La question du troisi\u00e8me mandat reste au c\u0153ur des inqui\u00e9tudes<\/h2>\n

F\u00e9lix Tshisekedi effectue son deuxi\u00e8me mandat, qui doit s\u2019achever en 2028. La Constitution congolaise prot\u00e8ge le nombre et la dur\u00e9e des mandats pr\u00e9sidentiels contre toute modification. Malgr\u00e9 cette garantie, les opposants au projet redoutent qu\u2019un futur r\u00e9f\u00e9rendum ouvre une nouvelle bataille autour des r\u00e8gles \u00e9lectorales.<\/p>\n

Le d\u00e9bat est devenu plus sensible depuis que F\u00e9lix Tshisekedi a laiss\u00e9 ouverte la question d\u2019un troisi\u00e8me mandat<\/a>. Ses partisans soutiennent qu\u2019aucune initiative visant \u00e0 prolonger son pouvoir n\u2019a \u00e9t\u00e9 officiellement engag\u00e9e. Ses adversaires, eux, r\u00e9clament des assurances avant m\u00eame la promulgation de la loi.<\/p>\n

La mobilisation actuelle ne vise donc pas seulement le contenu technique du texte. Elle traduit aussi une crise de confiance entre une partie de la soci\u00e9t\u00e9 civile et les institutions sur la finalit\u00e9 politique d\u2019un \u00e9ventuel r\u00e9f\u00e9rendum.<\/p>\n

Un appel \u00e0 privil\u00e9gier le dialogue et la s\u00e9curit\u00e9<\/h2>\n

Les 65 organisations demandent au pr\u00e9sident de consacrer les efforts de l\u2019\u00c9tat \u00e0 la s\u00e9curit\u00e9, au retour des d\u00e9plac\u00e9s et \u00e0 l\u2019am\u00e9lioration des conditions de vie. Elles pr\u00e9sentent le dialogue national comme une \u00e9tape n\u00e9cessaire avant toute consultation populaire sur des questions institutionnelles majeures.<\/p>\n

La d\u00e9cision revient d\u00e9sormais \u00e0 F\u00e9lix Tshisekedi. Une promulgation ferait entrer la loi en vigueur, tandis qu\u2019un report pourrait apaiser provisoirement la contestation.
