Les avocats du chanteur de R&B all\u00e8guent que des fonctionnaires f\u00e9d\u00e9raux ont conspir\u00e9 pour mettre sa vie en danger derri\u00e8re les barreaux.<\/p>\n

Le<\/span>\u00a0chanteur de R&B en disgr\u00e2ce\u00a0R. Kelly<\/strong>\u00a0a d\u00e9pos\u00e9 une requ\u00eate urgente demandant sa lib\u00e9ration de la prison f\u00e9d\u00e9rale, arguant que sa vie est en danger imminent en raison d’un complot pr\u00e9tendument orchestr\u00e9 par les responsables de la prison.<\/p>\n

L’homme de 58 ans\u00a0purge actuellement plusieurs d\u00e9cennies de prison\u00a0pour des d\u00e9lits de racket, de trafic sexuel et de pornographie infantile.<\/p>\n

Selon les documents judiciaires, trois responsables du Bureau des prisons (BOP) auraient conspir\u00e9 avec le d\u00e9tenu de la Fraternit\u00e9 aryenne Mikeal Glenn Stine pour faire assassiner Kelly en \u00e9change de la lib\u00e9ration anticip\u00e9e de Stine.<\/p>\n

L’affidavit – qui comprend le t\u00e9moignage sous serment de Stine – d\u00e9crit les tentatives r\u00e9p\u00e9t\u00e9es du personnel p\u00e9nitentiaire pour le recruter pour le complot alors qu’il \u00e9tait d\u00e9tenu \u00e0 Tucson, en Arizona.<\/p>\n

Les accusations \u00e9branlent la surveillance des prisons<\/h2>\n

Stine<\/strong>\u00a0, identifi\u00e9 dans les documents comme un dirigeant de la Fraternit\u00e9 aryenne en phase terminale, affirme avoir \u00e9t\u00e9 contact\u00e9 \u00ab\u00a0en mars\u00a0\u00bb apr\u00e8s avoir \u00e9t\u00e9 transf\u00e9r\u00e9 dans la m\u00eame unit\u00e9 que\u00a0Kelly<\/strong>\u00a0. Il affirme que le personnel p\u00e9nitentiaire lui a promis la libert\u00e9 et un soutien financier continu s’il commettait le meurtre.<\/p>\n

Il affirme que les policiers lui ont dit : \u00ab Vous devez faire ce pour quoi vous \u00eates venus. \u00bb Lorsque\u00a0Stine<\/strong>\u00a0a r\u00e9v\u00e9l\u00e9 le complot \u00e0\u00a0Kelly<\/strong>\u00a0, les policiers l’auraient transf\u00e9r\u00e9 dans le m\u00eame logement, suivant les instructions de continuer \u00e0 surveiller le chanteur.<\/p>\n

Stine<\/strong>\u00a0a \u00e9galement d\u00e9clar\u00e9 aux avocats qu’il avait appris plus tard que davantage de membres de la Confr\u00e9rie aryenne \u00e9taient recrut\u00e9s pour ce poste : \u00ab La menace sur la vie\u00a0de M. Kelly<\/strong>\u00a0continue chaque jour o\u00f9 aucune mesure n’est prise \u00bb, affirment les documents judiciaires, avertissant que d’autres recrutements sont en cours.<\/p>\n

L’\u00e9quipe juridique de Kelly<\/strong>\u00a0a pr\u00e9sent\u00e9 cette demande comme une demande de protection, qualifiant le maintien en d\u00e9tention dans ces conditions de \u00ab\u00a0peine cruelle et inhabituelle\u00a0\u00bb. L’avocat\u00a0Beau Brindley<\/strong>\u00a0soutient que le confinement \u00e0 domicile r\u00e9duirait consid\u00e9rablement le risque pour la s\u00e9curit\u00e9\u00a0de Kelly<\/strong>\u00a0.<\/p>\n

\u00ab L\u2019incarc\u00e9ration prolong\u00e9e de M.\u00a0Kelly<\/strong>\u00a0alors qu\u2019il sait que sa vie est en danger constitue une peine cruelle et inhabituelle \u00bb, stipule la motion.<\/p>\n

Assignation \u00e0 r\u00e9sidence ou maintien en d\u00e9tention ?<\/h2>\n

Il est \u00e0 noter que ce n’est pas la premi\u00e8re demande\u00a0de Kelly<\/strong>\u00a0li\u00e9e \u00e0 sa s\u00e9curit\u00e9. En 2020, il avait demand\u00e9 sa lib\u00e9ration apr\u00e8s avoir \u00e9t\u00e9 agress\u00e9 par un d\u00e9tenu au Centre correctionnel m\u00e9tropolitain de Chicago \u2013 un appel qui avait finalement \u00e9t\u00e9 rejet\u00e9.<\/p>\n

Kelly<\/strong>\u00a0purge actuellement des peines f\u00e9d\u00e9rales\u00a0concurrentes de 30 et 20 ans \u00e0 la prison Butner Medium I, en Caroline du Nord. Bien qu’il soit incarc\u00e9r\u00e9 pour des crimes graves, les all\u00e9gations laissent entrevoir de potentielles fautes au sein du syst\u00e8me p\u00e9nitentiaire. Si le BOP a sciemment facilit\u00e9 un complot d’assassinat, cela soul\u00e8verait de profondes questions de surveillance et de responsabilit\u00e9.<\/p>\n

Les d\u00e9fenseurs de conditions carc\u00e9rales \u00e9quitables soulignent que m\u00eame les d\u00e9tenus condamn\u00e9s conservent leurs droits fondamentaux, notamment le droit \u00e0 la s\u00e9curit\u00e9 et \u00e0 une proc\u00e9dure r\u00e9guli\u00e8re. La motion actuelle amplifie les inqui\u00e9tudes plus g\u00e9n\u00e9rales concernant la corruption interne et le traitement des prisonniers de haut rang.<\/span><\/p>\n

Alors que le tribunal examine la demande\u00a0<\/span>de Kelly<\/span><\/strong>\u00a0, l’attention se portera probablement non seulement sur son sort, mais aussi sur les autorit\u00e9s p\u00e9nitentiaires impliqu\u00e9es.
