{"id":325168,"date":"2022-05-14T14:32:09","date_gmt":"2022-05-14T14:32:09","guid":{"rendered":"https:\/\/afrikmag.com\/var\/www\/vhosts\/afrikmag.compublic_html\/?p=325168"},"modified":"2022-05-14T14:33:40","modified_gmt":"2022-05-14T14:33:40","slug":"derniere-reinhumation-de-robert-mugabe-la-haute-cour-statue-en-faveur-de-ses-enfants","status":"publish","type":"post","link":"https:\/\/afrikmag.com\/var\/www\/vhosts\/afrikmag.compublic_html\/derniere-reinhumation-de-robert-mugabe-la-haute-cour-statue-en-faveur-de-ses-enfants\/","title":{"rendered":"Derni\u00e8re r\u00e9inhumation de Robert Mugabe\u00a0: La Haute Cour statue en faveur de ses enfants"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">La Haute Cour a statu\u00e9 jeudi que les enfants\u00a0de feu l&rsquo;ancien pr\u00e9sident Robert Mugabe\u00a0qui contestent l&rsquo;exhumation de la d\u00e9pouille de leur p\u00e8re pour une nouvelle inhumation au National Heroes Acre ont le pouvoir de faire partie de la proc\u00e9dure judiciaire.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La magistrate de Chinhoyi, Ruth Moyo, avait jug\u00e9 que les enfants de Mugabe n&rsquo;avaient pas le droit de faire appel d&rsquo;un jugement rendu par le tribunal traditionnel contre leur m\u00e8re, Grace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bona Mutsahuni\u00a0,\u00a0Robert Tinotenda\u00a0et\u00a0Bellarmine\u00a0contestaient l&rsquo;exhumation des restes de Mugabe et la confiscation de leur b\u00e9tail, comme l&rsquo;avait ordonn\u00e9 le chef Zvimba, Stanley Mhondoro.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New Zimbabwe\u00a0rapporte que dans le jugement, les juges Amy Tsanga et Fatima Maxwell ont d\u00e9clar\u00e9 que dans le contexte du droit coutumier, le tribunal ne trouve aucune absurdit\u00e9 \u00e0 permettre \u00e0 toute personne l\u00e9s\u00e9e par une d\u00e9cision d&rsquo;un tribunal communautaire de faire appel contre elle, m\u00eame si la personne l\u00e9s\u00e9e n&rsquo;\u00e9tait pas partie prenante \u00e0 une proc\u00e9dure devant le tribunal communautaire.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-pale-cyan-blue-color\">\u00ab La juridiction inf\u00e9rieure a commis une erreur en limitant le droit d&rsquo;appel aux personnes qui ont lanc\u00e9 une proc\u00e9dure devant le tribunal communautaire.\u00a0Sur la base de ce qui pr\u00e9c\u00e8de, les premier et deuxi\u00e8me moyens d&rsquo;appel sont accueillis.<\/mark><\/strong><\/em><\/p><p><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-pale-cyan-blue-color\">L&rsquo;appel est et est accueilli avec d\u00e9pens.\u00a0Le jugement du tribunal a quo est infirm\u00e9 et remplac\u00e9 comme suit, le premier point pr\u00e9liminaire \u00e9tant et est par la pr\u00e9sente rejet\u00e9 et les d\u00e9pens suivant la cause.<\/mark><\/strong><\/em><\/p><p><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-pale-cyan-blue-color\">Les juges ont \u00e9galement renvoy\u00e9 l&rsquo;affaire au tribunal de premi\u00e8re instance de Chinhoyi pour la poursuite de l&rsquo;audience.<\/mark><\/strong><\/em><\/p><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Mugabe est d\u00e9c\u00e9d\u00e9 \u00e0 l&rsquo;\u00e2ge de 95 ans en septembre 2019 et a \u00e9t\u00e9 enterr\u00e9 \u00e0 Kutama apr\u00e8s que sa famille ait refus\u00e9 de le faire inhumer au National Heroes Acre.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En mai 2021, le chef Zvimba a ordonn\u00e9 l&rsquo;exhumation de Mugabe de sa maison rurale et a inflig\u00e9 une amende \u00e0 Grace pour avoir enfreint les rites fun\u00e9raires.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un messager du tribunal a \u00e9t\u00e9 autoris\u00e9 \u00e0 saisir cinq g\u00e9nisses et une ch\u00e8vre.&nbsp;Bona et ses fr\u00e8res et s\u0153urs ont fait appel du jugement devant le tribunal d&rsquo;instance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tinos Manongovere, un villageois \u00e0 l&rsquo;origine de l&rsquo;affaire, a contest\u00e9 l&rsquo;appel et les magistrats ont confirm\u00e9 la contestation de Manongovere.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cela a incit\u00e9 Bona et ses fr\u00e8res et s\u0153urs \u00e0 faire appel de la d\u00e9cision de la Haute Cour qui a statu\u00e9 en leur faveur.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Haute Cour a statu\u00e9 jeudi que les enfants\u00a0de feu l&rsquo;ancien pr\u00e9sident Robert Mugabe\u00a0qui contestent l&rsquo;exhumation de la d\u00e9pouille de leur p\u00e8re pour une nouvelle inhumation au National Heroes Acre ont le pouvoir de faire partie de la proc\u00e9dure judiciaire.
