Le pr\u00e9sident de la r\u00e9publique a renvoy\u00e9 le code p\u00e9nal \u00e0 l\u2019Assembl\u00e9e nationale pour un r\u00e9examen en ce qui concerne l\u2019immunit\u00e9 des Ministres<\/p>\n

C\u2019est un triomphe pour le d\u00e9put\u00e9 Martin Oyono, seul \u00e9lu du parti au pouvoir Camerounais (RDPC) qui s\u2019\u00e9tait oppos\u00e9 au vote de l\u2019article 127, tout comme les d\u00e9put\u00e9s de l\u2019opposition, notamment du SDF et du MRC.<\/p>\n

C\u2019est une grosse injure du Pr\u00e9sident de la R\u00e9publique aux Parlementaires qui avaient vot\u00e9 la totalit\u00e9 du projet du Code p\u00e9nal soumis par le gouvernement. Apr\u00e8s son examen et son adoption en s\u00e9ance pl\u00e9ni\u00e8re \u00e0 l\u2019Assembl\u00e9e Nationale le mercredi 22 juin 2016 et au S\u00e9nat hier mardi 28 juin 2016, le nouveau Code p\u00e9nal qui n\u2019est pas appr\u00e9ci\u00e9 par la majorit\u00e9 de la population, \u00e9tait d\u00e9j\u00e0 \u00e0 la pr\u00e9sidence de la R\u00e9publique pour attendre sa promulgation avant son entr\u00e9e en vigueur.<\/p>\n

Le pr\u00e9sident Paul Biya a refus\u00e9 de le valider ce code p\u00e9nal apr\u00e8s l\u2019avoir minutieusement analys\u00e9. Il a renvoy\u00e9 le texte au Parlement avec des indications pr\u00e9cises.<\/p>\n

\u00abLe pr\u00e9sident a demand\u00e9 qu\u2019on amende l\u2019article 127 qui accorde l\u2019immunit\u00e9 aux membres du gouvernement. Sachons que la personne qui se pr\u00e9vaut d\u2019une immunit\u00e9 doit justifier d\u2019un texte de loi. A l\u2019\u00e9tat actuel des choses, les membres du Gouvernement ne b\u00e9n\u00e9ficient d\u2019aucun texte de loi qui leur conf\u00e8re une quelconque immunit\u00e9. Par exemple, le pr\u00e9sident de la R\u00e9publique a une immunit\u00e9 conf\u00e9r\u00e9e par la constitution, les parlementaires b\u00e9n\u00e9ficient d\u2019une immunit\u00e9 conf\u00e9r\u00e9e par une loi. Mais, les membres du Gouvernement n\u2019ont aucune loi qui leur conf\u00e8re une immunit\u00e9<\/em>\u00bb<\/p><\/blockquote>\n

C\u2019est un triomphe pour ce d\u00e9put\u00e9 RDPC du d\u00e9partement de l\u2019Oc\u00e9an, R\u00e9gion du Sud. Pr\u00e9cisons qu\u2019il avait \u00e9t\u00e9 le seul \u00e9lu du parti politique au pouvoir \u00e0 d\u00e9clarer \u00e0 haute intelligible voix qu\u2019il \u00e9tait ill\u00e9gal d\u2019adopter l\u2019article 127 qui accordait l\u2019immunit\u00e9 aux membres du gouvernement.<\/p>\n

\u00abLes Membres du gouvernement sont gestionnaires et \u00e0 ce titre, ils r\u00e9pondent devant le Parlement qui est charg\u00e9 de contr\u00f4ler l\u2019action gouvernementale. Si on est gestionnaire et qu\u2019on a aussi l\u2019immunit\u00e9, cela veut dire qu\u2019on est juge et parti, donc, on est au-dessus de la loi. Cette situation viole m\u00eame le pr\u00e9ambule de la constitution de la R\u00e9publique. C\u2019est pour cela que, pendant la discussion g\u00e9n\u00e9rale, j\u2019ai dit que je ne pouvais pas prendre la responsabilit\u00e9 de voter une disposition qui va \u00e0 l\u2019encontre de la constitution. Donc, je ne fais que assumer ma responsabilit\u00e9<\/em>\u00bb<\/p><\/blockquote>\n

avait d\u00e9taill\u00e9 \u00a0l\u2019honorable Martin Oyono, en ajoutant que \u00abc\u2019\u00e9tait la discussion la plus sc\u00e9l\u00e9rate par rapport \u00e0 la lutte contre la corruption<\/em>\u00bb. Pour manifester son m\u00e9contentement au passage en force de l\u2019article controvers\u00e9, il avait quitt\u00e9 la salle au m\u00eame moment que ses pairs du SDF et du MRC, deux partis de l\u2019opposition.
\nD\u00e8s que le texte est arriv\u00e9 \u00e0 la pr\u00e9sidence, les membres de la Commission des lois constitutionnelles se sont rassembl\u00e9s pour mettre en application les instructions du pr\u00e9sident de la R\u00e9publique. Au final, il n\u2019y a plus d\u2019immunit\u00e9 pour les membres du gouvernement dans le nouveau code p\u00e9nal.<\/p>\n

L\u2019Assembl\u00e9e nationale va \u00e0 son tour se r\u00e9unir en s\u00e9ance pl\u00e9ni\u00e8re pour l\u2019amendement de cet article controvers\u00e9. \u00abD\u00e8s que les Parlementaires vont finir de l\u2019adopter, on va envoyer le Code p\u00e9nal au pr\u00e9sident de la R\u00e9publique pour promulgation<\/em>\u00bb.
\nSoulignons que beaucoup d\u2019autres articles en dehors de l\u2019article 127 ne font pas l\u2019unanimit\u00e9. Mais, selon toute vraisemblance, Paul Biya n\u2019a eu \u00e0 redire que sur l\u2019article 127.<\/p>\n
