Zana (41 ans), S. Karim (23 ans), G. Z\u00e9bi\u00e9 (19 ans) et D. Fidias (18 ans) ont comparu devant le tribunal des flagrants d\u00e9lits du Plateau, mercredi 25 mai dernier, pour r\u00e9pondre des faits de d\u00e9tention de cannabis en vue de la consommation. Des faits qu’ils ne reconnaissent pas.<\/p>\n

Les 4 pr\u00e9venus ont \u00e9t\u00e9 pris dans le filet des \u00e9l\u00e9ments de la Direction de la Police des Stup\u00e9fiants et des Drogues au cours d’une rafle. Selon le proc\u00e8s-verbal d’interpellation, ces individus ont \u00e9t\u00e9 interpell\u00e9s dans un fumoir. Avec en leur possession du cannabis, pr\u00e8s de 500 g, dans un sachet noir. Apr\u00e8s leur s\u00e9jour au violon de la Pr\u00e9fecture de police au Plateau, les 4 individus sont d\u00e9f\u00e9r\u00e9s devant le parquet pour comparution devant le juge.<\/p>\n

Le 25 mai dernier, ils sont appel\u00e9s \u00e0 la barre. Interrog\u00e9, K. Zana explique qu’il se rendait \u00e0 son lieu de travail. Quant \u00e0 S. Karim, se disant apprenti chauffeur, il soutient qu’il revenait d’un voyage quand il a \u00e9t\u00e9 interpell\u00e9. A peine a-t-il travers\u00e9 la voie, selon lui, qu’il croise les \u00e9l\u00e9ments de la Dpsd. Il est aussit\u00f4t arr\u00eat\u00e9. \u00ab\u00a0A la pr\u00e9fecture de police, j’ai pass\u00e9 4 jours. Je n’ai pas pu appeler mes parents\u00a0\u00bb, s’est-il plaint au juge. Mais le juge lui a rappel\u00e9 qu’il a reconnu les faits \u00e0 la police. Et qu’il a m\u00eame affirm\u00e9 qu’il venait d’acheter de la drogue pour 200 francs. Ce que le pr\u00e9venu nie. G. Z\u00e9bi\u00e9 \u00e0 son tour, d\u00e9clare qu’il a \u00e9t\u00e9 interpell\u00e9 \u00e0 Agban. Et qu’il ne connait pas les autres.<\/p>\n

Le procureur expliquera au juge que les 4 pr\u00e9venus ont \u00e9t\u00e9 effectivement interpell\u00e9s dans un fumoir, contrairement \u00e0 leurs affirmations. Mais rien ne dit dans le dossier qu’ils \u00e9taient en train de consommer de la drogue. De la drogue a \u00e9t\u00e9 retrouv\u00e9e dans un sachet noir dans le fumoir. Mais les policiers n’ont pas non plus rapport\u00e9 la preuve que cette drogue appartient aux pr\u00e9venus. En cons\u00e9quence, le procureur a conclu que les faits de d\u00e9tention de drogue en vue de sa consommation mis \u00e0 la charge des pr\u00e9venus ne sont pas \u00e9tablis. Il a donc requis la relaxe. Le juge \u00e0 son tour va d\u00e9clarer les 4 pr\u00e9venus non coupables et les relaxer.<\/p>\n

Ils ont d\u00fb pousser un \u00e9norme ouf de soulagement.<\/p>\n
