Laban Sabiti, un commer\u00e7ant de 29 ans du village de Bishayu, en Ouganda, s’est retrouv\u00e9 seul avec ses cinq enfants, dont un tout-petit de 13 mois.<\/p>\n\n\n\n

M. Sabiti s’est retrouv\u00e9 \u00e0 g\u00e9rer les enfants apr\u00e8s que son beau-p\u00e8re, M. Geoffrey Kakona, aurait r\u00e9cup\u00e9r\u00e9 sa fille parce que Sabiti n’aurait pas r\u00e9gl\u00e9 les arri\u00e9r\u00e9s de la dot. Un montant de 6 millions de shillings.\u00a0\u00a0<\/p>\n\n\n\n

\u201cIl est vrai que j’ai retard\u00e9 le paiement de la dot de la mari\u00e9e mais j’avais l’intention de la payer en d\u00e9cembre de cette ann\u00e9e. J’ai \u00e9t\u00e9 surpris lorsque mon beau-p\u00e8re est venu et a pris ma femme, Mme Prize Twikirize m\u00eame apr\u00e8s lui avoir expliqu\u00e9 que j’\u00e9tais pr\u00eat \u00e0 remplir\u00a0\u00a0mon obligation traditionnelle\u00bb<\/em>, a d\u00e9clar\u00e9 M. Sabiti, qui a d\u00e9pos\u00e9 une plainte pour n\u00e9gligence envers les enfants aupr\u00e8s de la police.<\/p>\n\n\n\n

L’a\u00een\u00e9 des enfants de M. Sabiti a 10 ans, tandis que le plus jeune t\u00e9tait encore.<\/p>\n\n\n\n

Les d\u00e9boires de M. Sabiti mettent en \u00e9vidence la marginalisation et l’affaiblissement des jeunes hommes qui ont l’intention de se marier. <\/p>\n\n\n\n

Le Premier ministre du royaume d’Ankole, George William Katatumba, note que les normes traditionnelles n’ont pas \u00e9t\u00e9 respect\u00e9es dans le cas de M. Sabiti puisqu’il n’y avait pas de mariage reconnu.  <\/p>\n\n\n\n

\u201cComme Sabiiti a engendr\u00e9 des enfants, il doit payer une amende qui consiste g\u00e9n\u00e9ralement en de la farine de mil, un jerrycan de Tonto, une ch\u00e8vre ou un mouton\u00a0\u00bb,<\/em> r\u00e9v\u00e8le M. Katatumba.<\/p>\n\n\n\n

L’officier sup\u00e9rieur de probation du district de Mbarara, M. Steven Tumwiine, a pes\u00e9 dans le d\u00e9bat, affirmant que le prix de la mari\u00e9e \u00e9tait interdit par le gouvernement.<\/p>\n\n\n\n

\u201cSelon les lois de l’Ouganda, la dot ou le prix de la mari\u00e9e a \u00e9t\u00e9 aboli et toute personne \u00e2g\u00e9e de 18 ans et plus a le droit d’\u00e9pouser un homme ou une femme de son choix. Ainsi, le vieil homme [le p\u00e8re de Mme Twikirize] enfreint  Les droits de sa fille. Le vieil homme porte \u00e9galement atteinte aux droits de ses petits-enfants en leur refusant la possibilit\u00e9 d’avoir des parents\u00a0\u00bb.<\/em> <\/p>\n\n\n\n

Le tribunal a jug\u00e9 que \u00ab la coutume du mariage en question n’\u00e9tait pas inconstitutionnelle <\/em>\u00bb. <\/p>\n\n\n\n
