La d\u00e9cision de la Cour P\u00e9nale Internationale de ne plus rechercher, poursuivre et juger Simone d\u00e9coule d’un constat sans appel du nouveau procureur. Selon le Procureur Khan, la n\u00e9cessit\u00e9 dudit mandat \u00e0 l’aune du proc\u00e8s Gbagbo\/ Bl\u00e9 Goud\u00e9, devrait \u00eatre remise en cause.<\/strong><\/p>\n\n\n\n

Le nouveau procureur de la CPI est l’artisan principal de la lev\u00e9e du mandat d’arr\u00eat qui planait sur la t\u00eate de Simone Gbagbo depuis 2012. Un mandat qui l’emp\u00eachait de sortir de la C\u00f4te d’Ivoire. Le Procureur de la CPI se basant sur les conclusions du proc\u00e8s retentissant de Fatou Bensouda contre Laurent Gbagbo et Bl\u00e9 Goud\u00e9, estime qu’\u00e0 ce stade de la proc\u00e9dure et vu les \u00e9l\u00e9ments all\u00e9gu\u00e9s par l’ex-procureure, aucune preuve ne peut \u00eatre trouv\u00e9e contre Simone Gbagbo.<\/p>\n\n\n\n

Dans sa requ\u00eate d\u00e9pos\u00e9e le 15 juin 2021, le nouveau Procureur de la CPI indique ceci : \u00ab L’Accusation [il] a examin\u00e9 les \u00e9l\u00e9ments de preuve \u00e0 l’appui de l’affaire contre Mme Simone Gbagbo \u00e0 la lumi\u00e8re des d\u00e9cisions majoritaires et minoritaires dans la d\u00e9cision No Case to Answer de la Chambre de premi\u00e8re instance, ainsi que du jugement de la Chambre d’appel. Il l’a fait conform\u00e9ment \u00e0 son devoir en vertu de la norme 60 du R\u00e8glement du Bureau du Procureur. \u00c0 l’issue de cet examen, l’Accusation a conclu qu’il n’y avait aucune chance raisonnable qu’elle puisse prouver l’affaire contre Mme Simone Gbagbo au seuil de preuve n\u00e9cessaire si le mandat d’arr\u00eat \u00e9tait ex\u00e9cut\u00e9 \u00bb<\/em>.<\/p>\n\n\n\n

Ces arguments du Procureur ont manifestement convaincu les juges qui ont abond\u00e9 dans son sens dans leur d\u00e9cision. En effet, selon les juges, \u00ab\u00a0les all\u00e9gations port\u00e9es contre elle ont \u00e9t\u00e9 largement test\u00e9s dans le proc\u00e8s contre Laurent Gbagbo et Charles Bl\u00e9 Goud\u00e9, y compris en particulier les \u00e9l\u00e9ments contextuels des crimes contre l’humanit\u00e9 all\u00e9gu\u00e9s, qui sous-tendent \u00e9galement les all\u00e9gations contre M. et Mme Gbagbo\u00a0\u00bb.<\/em> <\/p>\n\n\n\n

Ils ajoutent que \u00ab\u00a0Les \u00e9l\u00e9ments de preuve pr\u00e9sent\u00e9s ont \u00e9t\u00e9 jug\u00e9s incapables d’\u00e9tayer une condamnation, notamment parce que le procureur \u00ab n’a pas d\u00e9montr\u00e9 l’existence de la politique pr\u00e9sum\u00e9e visant \u00e0 attaquer une population civile sur la base des modes de violence all\u00e9gu\u00e9s et d’autres preuves indirectes cit\u00e9es \u00e0 l’appui \u00bb<\/em>.<\/p>\n\n\n\n

En tenant compte donc de l’avis du Procureur, La Chambre a aussi constat\u00e9 que les d\u00e9veloppements au stade du proc\u00e8s et de l’appel de l’affaire de M. Gbagbo font appara\u00eetre que les \u00e9l\u00e9ments de preuve sur lesquels le mandat d’arr\u00eat contre Simone Gbagbo \u00e9tait fond\u00e9 ne peuvent plus \u00eatre consid\u00e9r\u00e9s comme satisfaisant au seuil de preuve requis \u00e0 l’article 58(1 )(a) du Statut.<\/em>\u00a0\u00bb Fin d’un marathon judiciaire avec une fois de plus la victoire du camp Gbagbo.<\/p>\n","protected":false},"excerpt":{"rendered":"
