Seul dans le box des accus\u00e9s ce vendredi 13 novembre 2015, Yves Michel Fotso n\u2019a pas pu supporter. Agit\u00e9 et visiblement irrit\u00e9 par les propos du Procureur g\u00e9n\u00e9ral qui venait de lui faire comprendre que \u00absa\u00bb demande d\u2019arr\u00eat de poursuite n\u2019influence pas la poursuite de la proc\u00e9dure, l\u2019ex. Administrateur Directeur G\u00e9n\u00e9ral (ADG) de la Camair a \u00e9t\u00e9 victime d\u2019un malaise au cours de l\u2019audience relative \u00e0 la \u00abLiquidation Camair\u00bb.<\/p>\n<p>Heureusement, ses avocats et son \u00e9pouse \u00e9taient-l\u00e0, tr\u00e8s attentifs \u00e0 ses gestes. Ceux-ci ont accouru pour le soutenir et le conduire hors de la salle d\u2019audience. La dame et les avocats ont retir\u00e9 sa veste, sans doute pour lui permettre de mieux respirer. Peu de temps plus tard, le Pr\u00e9sident suspendait l\u2019audience, tandis que c\u2019est en bras de chemise qu\u2019Yves Michel Fotso a regagn\u00e9 le mini bus du secr\u00e9tariat d\u2019Etat \u00e0 la d\u00e9fense (Sed).<\/p>\n<p><strong>Yves Michel Fotso crie \u00e0 l\u2019arnaque<\/strong><\/p>\n<p>La derni\u00e8re audience relative \u00e0 ce volet a en effet \u00e9t\u00e9 assez houleuse. La coll\u00e9gialit\u00e9 du Pr\u00e9sident Moukouri Francis Claude a us\u00e9 de son savoir et du savoir faire pour calmer les esprits surchauff\u00e9s. L\u2019exp\u00e9rience de ce magistrat hors hi\u00e9rarchie et de ses deux juges a \u00e9t\u00e9 mise \u00e0 rude \u00e9preuve, sans pour autant \u00eatre malmen\u00e9e. D\u00e8s l\u2019entame de l\u2019audience, Me Achet, avocat attitr\u00e9 d\u2019Yves Michel, a soulev\u00e9 un certain nombre d\u2019exceptions\u00a0 et autres observations. Parmi lesquelles, l\u2019arr\u00eat des poursuites contre Yves Michel Fotso et la demande de sursis \u00e0 statuer.<\/p>\n<p>La demande est fond\u00e9e sur la restitution totale du corps d\u00e9lit, soit la somme de 1.750.661.315 Fcfa, conform\u00e9ment \u00e0 l\u2019article 3 du Protocole d\u2019Accord Transactionnelle sign\u00e9 le 14 Ao\u00fbt 2013 entre Yves Michel Fotso et le liquidateur Emile Christian Bekolo. La restitution du corps du d\u00e9lit est r\u00e9glement\u00e9e par l\u2019article 18-1 (nouveau) portant la loi organique du TCs.<\/p>\n<p>Le d\u00e9cret d\u2019application du 04 Ao\u00fbt 2013 fixe en son\u00a0 article 4 les modalit\u00e9s de restitution du corps du d\u00e9lit. Celle-ci peut \u00eatre faite en num\u00e9raire ou en nature. Me Achet ne s\u2019est pas content\u00e9 seulement de parler, mais a produit toutes les pi\u00e8ces li\u00e9es \u00e0 la restitution, faite en totalit\u00e9 en num\u00e9raire.
